General Terms and Conditions (GTC) of ExigeRC

1. Scope

(1) These General Terms and Conditions (GTC) apply to all orders placed via our online shop www.exige-rc.com.

(3) Deviating terms and conditions of the customer are not recognized unless we expressly agree to their validity in writing.

2. Conclusion of Contract

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
(2) By submitting your order, you submit a binding offer. Confirmation of receipt of your order will be sent automatically by email. The purchase contract is concluded as soon as we accept the order by means of an order confirmation or by delivery of the goods.

3. Products and Services

(1) We sell both commercial goods and products developed and manufactured by ExigeRC.
(2) We also offer a service for RC nitro engines. This includes re-clamping engines and replacing bearings if necessary.

Note on engine service:

• We do not guarantee or warrant the running behavior, durability, or performance of the engine after re-clamping or replacing bearings.

• The running behavior of an RC nitro engine depends on numerous parameters (e.g., installation, settings, fuel, outside temperature, driving style) that are beyond our control.

• By placing an order, you acknowledge this disclaimer.

 

4. Prices and Payment Terms

(1) All prices are in euros, including statutory VAT, plus shipping costs.
(2) The prices at the time of the order apply.

The prices valid at the time of the order are valid. (3) Payment is made using the payment methods offered in the shop.

5. Shipping and Delivery

(1) Shipping is to the delivery address provided by the customer.
(2) Delivery times are non-binding unless expressly guaranteed as binding.
(3) Upon delivery to the shipping service provider, the risk of accidental loss and accidental deterioration passes to the customer.

 

6. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period shall be 14 days from the day on which you or a third party designated by you takes possession of the goods.

To exercise your right of withdrawal, you must notify us

of your decision to withdraw from the contract by means of an unambiguous statement (e.g., by email or letter).

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the standard delivery offered), promptly and at the latest within 14 days of receiving your notice of withdrawal.

For the reimbursement, we will use the same means of payment that you used for the original transaction. We may refuse reimbursement until we have received the goods back or you have provided proof that you have returned the goods.

You must return the goods to us promptly, but no later than 14 days from the date of your notice of withdrawal. You will bear the direct costs of the return shipment.

Exclusion of the right of withdrawal:

The right of withdrawal does not apply to contracts for the delivery of goods manufactured according to customer specifications or clearly tailored to personal needs, as well as to services that have already been fully provided if you have expressly agreed before the start of performance that we may begin performance and you lose your right of withdrawal.

7. Warranty

(1) The statutory warranty rights apply.
(2) For used goods, the warranty period is one year from delivery.
(3) For engine service (re-clamping, bearing replacement), the following applies:

No warranty for the running behavior, performance, or durability of the engine.

Claims for damages are excluded unless there is intent or gross negligence on our part.

8. Liability

(1) We are liable without limitation for intent and gross negligence, as well as in accordance with mandatory statutory provisions (e.g., the Product Liability Act).
(2) In cases of slight negligence, we are only liable for damages resulting from the breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable, typically occurring damage.
(3) Further liability is excluded.

9. Retention of Title

The goods remain our property until full payment has been made.

10. Copyrights

All content of the shop (text, images, logos, product descriptions) is protected by copyright. Use without our express consent is not permitted.

11. Final Provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction is – to the extent permitted by law – the registered office of ExigeRC in 50374 Erftstadt.
(3) Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
